Supreme Court TIED 4-4 on DAPA/DACA+ Case

On June 23, 2016, the U.S. Supreme Court issued its one-line decision in United States v. Texas. The Court, evenly divided 4-4, was equally divided. This means that the underlying, nationwide injunction against DAPA and expanded DAPA remain in place.

The original DACA program from 2012 is not affected by this decision, nor are the enforcement priorities announced by President Obama in November 2014.

While the next steps are unknown for DAPA, DACA 2.0, it is unlikely that there will be a resolution before the end of the current administration. The case could even return to the Supreme Court. We will keep you updated moving forward.
